The man who tried to sue an Athens drug dog and other local officials was sentenced yesterday to a two-year prison term and a three-year driver's license suspension in the Athens County Court of Common Pleas.
Wayne Green also was ordered to pay $1,300 in attorney fees to Athens county and city for filing a frivolous lawsuit, said C. David Warren, Athens county prosecutor.
Green was convicted of the possession and trafficking of marijuana Nov. 30, 2005.
He voluntarily dismissed his lawsuit against the police dog and other local officials Mar. 31. Judge Fred M. Crow III also threw out the lawsuit without prejudice at a later hearing, allowing Green to re-file the lawsuit when he pays the $1,300 fee.
Wayne Green was suing the drug-sniffing dog, Andi, Sheriff Vern Castle, Athens County Common Pleas Court Judge Michael Ward, members of the Athens Police Department, members of the Athens County Sheriff's Office and members of the county prosecutor's office, including prosecutor C. David Warren, for an initial $450,000. He cited mental distress and property damages during the Nov. 19, 2003 search of his store and an adjacent building.
