Editor's note: The following is an open letter from Ohio University Director of Legal Affairs John F. Burns written May 17 in response to the American Association of University Professors about Administrative Evaluations. To: Kevin Mattson, Ph.DFrom: John F. Burns, Director, Office of Legal AffairsRe: AAUP EvaluationsDear Dr. Mattson,
The administration of Ohio University recognizes the OU Faculty Senate as the representative body for all OU faculty. The current attempt to circulate an administrative evaluation tool to review the performance of President Roderick J. McDavis, Provost Kathy Krendl and Vice President for University Outreach and Regional Campuses, Charles A. Bird will not be recognized, endorsed, validated or accepted by the administration of OU and the OU Board of Trustees.
Current OU Policy and Procedure which is contained in the Faculty Handbook charges the Board of Trustees with responsibility for evaluating the president, and the president is responsible for evaluating the provost and vice presidents.
This administration and the Board of Trustees consider the issue of the evaluation of the president and provost to be a matter under discussion with the Faculty Senate. The Executive Committee of the Faculty Senate has already had input into the president's evaluation last week and will have input into the provost's evaluation in the near future.
The AAUP's effort to evaluate the president, provost and a vice president circumvents and deprives the Faculty Senate of its recognized role in the shared governance of OU.
I have legally authorized the administration to deny the AAUP any right to utilize university resources to circulate or otherwise distribute and return the evaluation document or materials. Further, any material that is submitted will be returned to you.
I hope this memorandum clarifies this important point to you.
