Lawyers for the former Ohio University graduate student charged with murdering his father have asked a judge to dismiss charges against him and find prosecutors in contempt of court.
The March 21 motion alleges that prosecutors acted in bad faith by using an entire blood sample for forensic testing, even though Athens County Municipal Court Judge William Grim ordered that some of the blood sample be preserved.
After the case was transferred to Athens County Common Pleas Court, Judge Michael Ward ruled prosecutors could use the entire blood sample, but prosecutors had already used the entire sample before Ward made a decision, according to the motion filed by R.J. Shostak, attorney for Jonathan Bebb.
Bebb was charged Nov. 26 with the murder of his father, former OU history professor Phillip Bebb.-
