While the fate of the proposed strip club on Stimson Avenue remains in court, the zoning regulation that prevented developer Demetrios Prokos from building a restaurant on the property was changed.
The 11 and 13 W. Stimson Ave. property is in a B-3 business zone, which permits a restaurant, but the property is within 200 feet of a residential zone, and the code stated a restaurant could not be built that close to the area.
It came to our attention with the former New-To-You building. Mr. Prokos was saying it was very difficult to open and it was not intended to be making it that strict
said Councilwoman Deborah Phillips, D-4th Ward.
Athens City Council recently changed the code to state that only a drive-through restaurant is not allowed within 200 feet of a residential area to make it less restrictive. The change takes effect today.
The change does not affect Shade resident Chris Stotts, who proposed the strip club, because it post-dated his application, said Stotts' attorney Scott Mergenthaler. - Mergenthaler said. Basically it is adding an additional use to the area.
He said he is in the process of appealing previous denials from the city and will fight for whatever right Prokos and Stotts have to operate the strip club.
