OU student accused of rape, kidnapping wants statements to OUPD discarded from case

An Ohio University sophomore accused of kidnapping and raping a woman in Boyd Hall wants a judge to throw out statements he made to police.

K. Robert Toy, attorney for Matthew C. Kulchar, 20, of Dublin, wants anything his client told OU police while in custody thrown out, according to court filings, because Kulchar hadn't been told of his right to remain silent. A grand jury indicted Kulchar for rape, kidnapping and tampering with evidence in October.

He pleaded not guilty on Nov. 5 and is free on a $50,000 bond. Judge Michael Ward scheduled Kulchar's trial for Feb. 10.

Prosecutors allege that on Sept. 28, Kulchar entered a room in Boyd Hall and called out to the woman living there. Once she entered her room, Kulchar held her there and raped her for hours before leaving, according to court filings. The tampering with evidence charge, a third-degree felony, stems from a phone call that prosecutors say Kulchar made to one of his roommates, telling that person to dispose of her underwear.

Rape and kidnapping are both first-degree felonies, punishable by three to 10 years in prison and a fine of up to $20,000. The tampering with evidence charge, a third-degree felony, carries a $10,000 fine and up to five years in prison.
