Court records detailing a former Athens police officer's convictions for dereliction of duty will soon be removed from public view.
Former officer Brian Lushbaugh pleaded guilty to the two second-degree misdemeanors following allegations that he had sex with two members of a police-training program. Municipal Judge William Grim ruled Friday that all official records of this case be sealed and all index references to the case deleted
subject only to exceptions contained in Ohio law.
The convictions will be expunged from court records as part of a plea agreement in which Lushbaugh agreed not to appeal the revocation of his peace officer certification in exchange for a clean record. Law enforcement officers and others with special permission may still view the convictions, but they will no longer appear in court records.
As of yesterday afternoon, Lushbaugh's conviction was still listed on the Municipal Court's Web site.
