A West Virginia man is suing Ohio University for lost wages allegedly caused by a fall while attending an on-campus play.
Russel Lyon, of Huntington, W.Va., fell down stairs at Templeton-Blackburn Alumni Memorial Auditorium while attending a production of The Drowsy Chaperone last January.
He is suing OU in the Ohio Court of Claims for $25,000 to cover medical, hospital and rehabilitation costs, according to court documents.
Lyon left his seat before the play began but after the house lights darkened. When Lyon tried to leave the auditorium, he tripped and fell down the staircase.
Lyon claims the incident occurred because OU failed to properly light, maintain and warn the public about the dangers of the staircase.
Lyon suffered acute subdural brain bleed, traumatic brain injuries, and contusions causing memory problems, language problems and dizziness, according to the documents.
OU has not issued a response to the complaint, and the case is still pending.
