Lengthy brief averts appeal of conviction

The appeal of a Philadelphia man convicted of raping an Athens woman he met online was denied Monday because it exceeded the legal length.

Charles Nguyen, 32, was convicted of one count each of rape, kidnapping, burglary and tampering with evidence after his trial August 2010 trial. He was sentenced to 30 years in prison.

Nguyen filed an appeal brief last week claiming that all four of his convictions should be overturned. He cited evidence misuse and contradictory testimony from the victim and Athens County Sheriff deputies.

The court denied the brief because it exceeded the court’s page limitations of 35 pages. Nguyen’s brief was 55 pages long. He filed a motion on informing the court that the brief would exceed the page limit the same day he filed the brief, according to court documents.

The court claimed that Nguyen did not give enough time for the court to respond to the motion. The court ordered for the brief to be stricken from the record.
