David Hertzog Pleaded not guilty to three counts of gross sexual imposition

Man arraigned on gross sexual imposition charges

A 39-year-old man was arraigned yesterday on three counts of gross sexual imposition for molesting two children in 2009.

David R. Hartzog, of The Plains, was arraigned on three counts of gross sexual imposition in the Athens County Court of Common Pleas. He pleaded not guilty of all charges.

The charges stemmed from 2009, when he allegedly performed oral sex on a 3-year-old boy and fondled a 9-year-old girl while she was in the shower, according to court documents.

Hartzog’s bond was set at $750,000, and he is currently being held at the Southeastern Ohio Regional Jail.

Hartzog was arrested after Utah law enforcement officers tipped off the Athens County Sheriff’s Office about child pornography in The Plains, said Acting Athens County Prosecutor Keller Blackburn.

Gross sexual imposition is a third-degree felony. Hartzog could spend up to 15 years in prison and pay up to $30,000 if convicted of all charges, according to the Ohio Revised Code.

His trial is set to begin July 26.
