Glouster man pleads guilty to stealing 124 cartons of cigarettes

A Glouster, Ohio, man pleaded guilty to breaking and entering and possessing criminal tools after stealing 124 cartons of cigarettes from a local convenient store in August 2010. 

Derick A. Smith, 27, broke into an Albany Marathon by breaking the front glass of the store with a hammer, and removing the cigarette cartons, according to a news release.

Smith was later found with the hammer used to break the store glass in his vehicle. 

The defendant was sentenced to 23 months at the Southeastern Ohio Regional Jail, ordered to pay restitution to the Marathon, to pay court costs within six months and to forfeit the vehicle used to commit the offense. 

The case was investigated by the Athens County Sheriff's Office.
