Local sex offender to be transfered to Utah for further court procedures

A The Plains man, who could have spent 15 years in prison, will soon be released from the Southeastern Ohio Regional Jail after pleading guilty to three sex offenses.

David Hartzog, 40, pleaded guilty to three counts of sexual imposition as part of a plea agreement with the Athens County Prosecutor’s Office Wednesday.

Hartzog was originally charged with three counts of gross sexual imposition, a third-degree felony. He pleaded guilty to the lesser charges of sexual imposition, a third-degree misdemeanor.

He was charged with performing oral sex on a 3-year-old boy and fondling a 9-year-old girl in 2009, according to court documents.

He was arrested after the Athens County Sheriff’s Office was tipped off by Utah law enforcement about child pornography in The Plains, Athens County Prosecutor Keller Blackburn said in a previous interview.

Hartzog was sentenced to 180 days in jail and a $1,500 fine. He was given credit for the 180 days he has already spent in jail.

The jail is ordered to hold Hartzog until he can be transported to Utah, where he is charged with one count of sexual exploitation of a minor, according to the jail’s website.

Hartzog could have been sentenced to maximum of 15 years in prison and a $30,000 fine if convicted of his original charges at a trial, according to the Ohio Revised Code.
