University settles lawsuit over alleged misdiagnosis

A lawsuit seeking money for the loss of a former Ohio University student’s arm was recently settled, leaving OU shelling out hundreds of thousands of dollars.

Molly Millsop sued OU in the Ohio Court of Claims in January 2009, alleging that Hudson Health Center employees failed to diagnose her with necrotizing fasciitis, a rare bacterial infection commonly known as flesh-eating bacteria, according to a previous Post article.

To settle the case, OU will pay Millsop $250,000, according to court documents from July 2013.

Millsop alleges she lost her arm as a result of the misdiagnosis.

“OU is pleased that the parties were able to amicably resolve the litigation,” said OU spokeswoman Katie Quaranta, in an email. “The university wishes Molly Millsop and her family all the best.”

Millsop and her family originally sought $25,000 in the 2009 lawsuit after she was first diagnosed “with a sore throat, muscle strain and anxiety,” according to previous Post articles.

With her pain increasing and treatment remaining ineffective, Millsop’s parents drove from Dayton to Athens and took her to O’Bleness Memorial Hospital.

After she arrived at O’Bleness, Millsop was diagnosed and airlifted to Ohio State University Wexner Medical Center, where her arm and shoulder were amputated.

The settlement is not “an admission of liability on the part of (OU)” and Millsop cannot seek more in damages from the university, according to the court documents.
