A New York man convicted of a rape in Athens in 2010 appealed last week to have his sentence reviewed by the Ohio Supreme Court.
Charles Nguyen received three 10-year sentences: one for rape, a second for kidnapping and the last for aggravated burglary, according to court documents. His prison sentence was 30 years to life.
He was also charged with tampering with evidence.
Nguyen has twice in the past asked for his sentence to be reviewed by the 4th District Court of Appeals. While the first was thrown out, his second has resulted in the case being sent back to the Court of Common Pleas to review his sentence.
The Court of Common Pleas may choose to merge Nguyen’s sentences, resulting in a minimum sentence of 10 years in prison or imposing the original 30-year sentence.
Elizabeth Gaba, Nguyen’s attorney, filed the Supreme Court appeal on August 30, 2013, according to the court docket.
