Kelly must comply with subpoena

A judge ruled Tuesday that Athens County Sheriff Pat Kelly must comply with a request from the special grand jury convened as part of the state’s longstanding investigation against him.

Retired Summit County Judge Patricia Ann Cosgrove, who is overseeing the grand jury, issued the decision, which was filed with Athens County Clerk of Courts Ann Trout.

Even though the motion has been filed with the clerk, Cosgrove sealed the decision, meaning that only the parties involved are able to see the document.

“It’s a secret,” Trout said.

Kelly, on numerous occasions, has previously said that he wishes to not comply with a subpoena from a state investigator requiring he give up his confidential informants.

Kelly said Tuesday’s decision means he’ll have to comply, but he couldn’t confirm that Tuesday’s ruling was in reference to the confidential informants subpoena.

“There’s really nothing for us to disclose that they didn’t already have,” Kelly said. “I don’t have any problems with (Cosgrove’s) decision. This doesn’t affect anything going forward.”

Cuyahoga County Prosecutor Timothy McGinty, who was appointed to represent Kelly, could not be reached for comment by press time.
