Local man sentenced to four years in prison for possessing 800 hits of LSD

A Cutler man who was arrested last January for possession of almost 800 hits of LSD pleaded guilty to the charge in court Wednesday.

Jeremy Cutshaw, 42, pleaded guilty to an indictment charging one count of possession of LSD, a second-degree felony because there were more than 250 hits, according to the Ohio Revised Code.

Athens County Sheriff Deputy John Morris originally arrived on the scene, pulling Cutshaw over for a minor traffic violation; however, after another officer arrived with a drug dog “approximately five to seven minutes after the initial stop,” according to court documents.

Athens County Common Pleas Court Judge L. Alan Goldsberry sentenced Cutshaw to four years in prison with no possibility of early release. He is also subject to a five-year suspension of his driver’s license.

“The dog ‘alerted’ to the defendant’s vehicle, thus providing probable cause for its search,” Goldsberry wrote in court documents. “Paraphernalia was found in the vehicle’s passenger compartment, and the subsequent search of the trunk revealed the LSD underlying the pending felony drug charge. None of this was unlawful.”

Cutshaw also had eight ounces of moonshine, marijuana, a bag of white powder thought to be ketamine and $2,600 in cash, which was stated on Sheriff Pat Kelly’s Facebook page about Cutshaw’s arrest at the time of the incident, according to a previous Post article

According to the Ohio Revised Code, Cutshaw could have received up to eight years in prison and a maximum fine of $15,000.

Cutshaw tried to file a motion to suppress evidence in his investigation in September, but that motion was overruled.

Cutshaw has been incarcerated in the Southeastern Ohio Regional Jail since his arrest on Jan. 19, 2013 and held on a bond of $25,000, according to the jail’s booking documents.
