in the Athens Municipal Court yesterday morning according to a court document.

Rape occurs when one person uses force or the threat of force to compel another person to engage in a sexual act according to the document.

A first-degree felony can carry up to a 10-year prison sentence

according to the Ohio Revised Code.

Simonis currently remains in Southeastern Ohio Regional Jail in Nelsonville.

The Athens County Prosecutor's Office will prosecute the case

according to the document.

the university would face a $15.7 million deficit.

Ohio University administrators are planning for potential budget cuts for the next two years - between 5 percent and 10 percent for 2011 and up to 15 percent for 2012

depending on federal and state funding.

The projections for next year assume a 3.5 percent tuition increase for undergraduates

but no increase in graduate tuition.

A 7 percent cut next year would not affect all units equally - some units would likely face deeper cuts
