A federal district judge dismissed a lawsuit Monday against Ohio University that stemmed from the plagiarism investigation within the Russ College of Engineering and Technology.
Jay Gunasekera, a mechanical engineering professor, was removed from his role as a graduate adviser following allegations of plagiarism within the engineering college last fall.
U.S. District Judge Algenon Marbley ruled last Wednesday that Gunesekera, a mechanical engineering professor, failed to prove that a graduate adviser position is a constitutionally protected right.
Attorney John Marshall, Gunesekera's representative, said they will appeal the decision.
The judge said that what they did to him was not considered a constitutional violation
Marshall said. We think that what the judge said was wrong so we're appealing.
Gunesekera was barred from advising graduate students for three years and stepped down from his position as mechanical engineering chair after the Bloemer-Meyer report released last May accused Gunesekera of allowing rampant and flagrant plagiarism according to a previous Post article.
A defamation complaint filed by Gunesekera against the university is still pending, Marshall said.
